November 29, 2010 - The Claims Administrator mailed payments to all Class Members on Wednesday, Nov. 24, 2010. We are unable to give you an exact date of when you will receive your check because of variables such as the delivery time of the U.S. Postal Service to and in your respective area. Please allow an appropriate amount of time for delivery of your check. However, if you have not received your check by Dec. 6, 2010, please contact the Claims Administrator at 1-800-252-5745. Please also contact the Claims Administrator if you have an address update.

October 1, 2010 – Today the Court issued its Order and Judgment Clarifying Final Approval of Settlement. This Order clarifies that the “Final Approval Date” of the Settlement is October 1, 2010 and that the Court’s September 3, 2010 Decision and Order approving the Settlement is a final judgment pursuant to Federal Rule of Civil Procedure 54(b), dismissing these actions with prejudice. Based upon the October 1, 2010 Order, it is now anticipated that barring any further delays, the Claims Administrator will be able to mail payments to Class Members by the end of November 2010. The exact date that payments will be made will be posted on this website during the first week of November, so please check back then for this information.
Sept. 3, 2010 – Today the Court issued its written Decision and Order (available here for download) granting final approval of the class action settlement with Kodak. Berger & Montague, P.C. and Garwin Gerstein & Fisher, LLP, have filed a Title VII class action race discrimination lawsuit against Eastman Kodak Company.
The suit was filed by ten current and former
African American employees of Kodak and the Employee
Committed for Justice, an organization of more than 900 African American current and former employees of Kodak. The lawsuit
was filed on behalf of all past, present and future
African American Kodak employees, and seeks to put an
end to years of racial discrimination.
